Memo for Customer or Supplier of Goods or Provider of Services

For what purpose and what kind of your personal data we collect and process?

For Customer:

For the proper and lawful execution of contracts and other agreements concluded in writing or verbally between the Company and the recipient of the service or, at the request of the data subject, the performance of actions prior to the signature of the contract with the Company or without such contract.	Prior to ordering a service: name, surname, phone number, e-mail address, delivery / construction site location. Other data, if you have submitted them yourself (e.g., when undersigning e-mails, at exhibitions, by phone, etc.).
	If you are applying on behalf of a legal entity: your name, surname, position, direct telephone number and email address; If you are applying as a natural person: name, surname, date of birth, farmer’s personal identification number (only on your own initiative), address of your place of residence, bank account number, phone number and e-mail address.
For statistical purposes through the Website, using cookies.	Websites, devices used by our Facebook account visitors, browser, operating system, gender, age group, language, city, region, etc.
For property protection.	Your image if you visit the area or buildings of our plant.

For Supplier:

For the protection of high value cargo (equipment / appliances) and health of the drivers, as well as for ensuring the performance of contracts (payment for the transport services discussed in the contracts by the kilometres travelled).	Data from the built-in GPS devices used by the carriers providing transport services to the Company. Note: If the data subject does not wish his data to be collected using GPS after working hours, the data subject is free not to use the vehicle owned by the employer during such hours.
For property protection.	Your image if you visit the area or buildings of our factory.

Do you have to submit your personal data?

For Customer:

We do not request to submit the data that are not necessary for performance of our activities when providing the services related to the abovementioned purposes for the collection of personal data. Therefore, by refusing to provide the necessary data, you, at the same time, refuse ordering our services as well, or, based on a good reason, you refuse further cooperation when the provision of services has already started.

For Supplier:

We do not request to submit the data that are not necessary for performance of our activities when purchasing the services / goods related to the abovementioned purposes for the collection of personal data. Therefore, by refusing to provide the necessary data, you, at the same time, refuse selling your services as well, or, based on a good reason, you refuse further cooperation when the provision of services has already started.

Where can we obtain your data?

For Customer:

We receive your data directly from you only, and, if you are a representative of a company, we may obtain your data from another contact person in that company (e.g., from the office administrator, manager, accountant, etc.).

For Supplier:

JWe collect your data directly from you and from publicly available contact details, and, if you are a representative of a company, we may obtain your data from another contact person in that company (e.g., from the office administrator, manager, accountant, etc.).

What rights do you have as a data subject?

Receive information about your data processing (for Customer)
Access your data (including video recordings), as well as get the copies thereof;
Request the rectification, erasure, transmission or limitation of processing of your data;
Request restriction of processing your data or
Request the transmission of your personal data to other data controllers;
Cancel the consent given for data processing;
Do not consent to the processing of non-mandatory data.
Complain about our actions.

How to exercise the rights that you have?

Submit a written request to the Manager of the Company or Marketing Manager by presenting your ID card or passport, or submit it by e-mail to info@borga.lt, if your request will be verified using your electronic signature.

We will respond within 30 days, unless such term is reasonably inadequate. In this case, you will be notified of the extension of the term and the reasons thereof.

Please indicate the following in your request: your name, surname, contact details and the right you wish to exercise.

To access your data, specify the information you wish to obtain (e.g., what kind of your data and for what purpose we process, where they were collected, to whom they were transmitted, etc.).
To obtain further information about your rights and their implementation, please make use of the contact details specified below.

Who can we transmit your personal data to?

To state authorities (State Tax Inspectorate, Sodra (the State Social Insurance Fund Board), courts, bailiffs, notaries public, law enforcement agencies) in compliance with the requirements of legal acts or on the basis of the protection of legitimate interests / rights of the Employer (e.g., debt collection, resolution of legal disputes, based on request of state authorities, etc.);
To lawyers, audit companies, and IT specialists: concerning execution of contracts;
To postal or courier services or providers of similar services: at your request or to ensure execution of contracts;
Within our group of companies in the territory of the EU / EEA: to ensure the harmonisation of contract terms and conditions or execution of a contract;
To another entity: where you have used the right to data portability, as described in the Rules.

When transferring your data, we act solely in your interests or in accordance with the requirements of legal acts, as well as we ensure the security of the data transferred at the time of the transfer.

How long can we store / process your data?

We safe-keep your data:

As long as required by legal acts, for example, contracts are safe-kept for 10 years from the contract expiry date and invoices for 10 years from the date of their issuance;
Correspondence, offers: for 3 years, except for the ordered services (for Supplier);
Throughout the warranty period, if a warranty period applies to the product purchased by you (for Customer);
Video recordings: for 20 days, if you visit the area of buildings of our factory;
Data backup copies: for 30 days;
GPS data: for 7 months (only on certain service providers).

You can always familiarise yourself with the submitted contracts and annexes thereto, receive additional information about your rights and their scope, and, if you suspect that any violations could have taken place, contact us and / or the relevant competent authorities: the State Data Protection Inspectorate, the court, etc.

You must ensure the confidentiality of the documents transferred to you, except for the cases where the disclosure is necessary for the protection of your rights (to public authorities, lawyers, auditors) (for Supplier).
